We challenged our prosecution in Detroit. They never had any intention to actually go to trial. They had a weak case and we knew it. But they tried all of their tricks and tactics to intimidate us.

That little Ho Brandon Helms knew from day one they didn’t have a case. From there it only got worse with Judge Murphy even telling him to sit down and shut up. He may have battered wife syndrome from McMillion. He quit on the last day and didn’t even show up for the verdict.

BOGUS CLAIMS OF BILLING FRAUD

CHRISTOPHER RUSSO MD, a graduate of the University of Michigan Medical School. He completed his residency in Anesthesiology at Ann Arbor, did a two-year fellowship in Pain Medicine at the University of South Florida, and a Post Fellowship in Advanced Interventional Pain Techniques at Moffit Cancer Center in Tampa, Florida. He and his co-defendants were indicted in a thirty-seven-page indictment. He was indicted on five counts of health care fraud, aiding and abetting. and found “Not Guilty.”

“Endless delays, media smears, slow trickle of discovery materials, freezing of our bank accounts, federal detention of our boss for 3.5 years Pretrial, multiple emails from the DOJ financial healthcare fraud investigator telling us they’ve subpoenaed our bank records, bogus claims of billing fraud such as billing while out of the country and billing of dead patients (no evidence of this presented at trial) house arrest, GPS ankle bracelets, threats of severe sentencing upon conviction if we didn’t accept their plea deals two days before the start of the trial, incomplete, incompetent and fractured digital record of our EMR charts, threats of outrageous restitution upon conviction.

From The Detroit News July 28, 2023: Among the higher-profile cases that McMillion worked on was the prosecution of Dr. Rajendra Bothra of Bloomfield Hills, who faced charges in an alleged $500 million health care fraud scheme. Bothra was acquitted last year after spending three years in jail prior to his trial.
Bothra was found not guilty of more than 40 federal counts along with his former employees, Ganiu Edu, David Lewis, Christopher Russo in what was considered one of the biggest losses for the U.S. Attorney’s Office in more than 10 years. The one-year anniversary of the acquittal is Thursday.

This included rational polypharmacy, including opioids and non-narcotic medications. DME, physical therapy, injections, urine drug screens, opioid agreements, pill counts, referrals to other specialists including addiction medicine and surgical consultations.

When it was actually broken down and presented to the jury, the prosecution narrative melted like an ice cube in the Arizona desert. They had no answers for an actual medical defense. We took them to the deep end of the pool, where they couldn’t swim.

In the federal criminal trial of the US versus Bothra et al., the prosecution was able to flip Ms. Campbell and convince her to testify against her former employer, Dr. Rajendra Bothra, who owned the Pain Center USA in Warren, Michigan. Ms. Campbell is a nurse practitioner specializing in family medicine.”

RUSSO’S NOTES

“We broke down the actual charts and explained our decision-making when it came to a multi-modal approach to pain management. During the actual trial and testimony, we focused on the actual science, medicine, and care of the actual chronic pain patients and their symptomatology and pathology.

She worked for the Pain Center USA for approximately four months. In federal court, she admitted under oath to having a little to no experience in treating chronic pain patients and that Dr. Bothra had provided her with educational Opportunities, including out-of-state pain medicine conferences and review courses.

Your pain doctor Hersh Patel MD, admitted in federal court that he gave unnecessary pain medication and administered pain injections outside the normal course of professional practice while working for Dr. Bothra in Detroit.

As a witness for the prosecution, Diane Campbell RN stated that the Pain Center USA was a “pill mill“. However, on cross-examination by defense counsel, she admitted that she had no knowledge of the 2016 CDC opioid prescribing guidelines and was oblivious to the concept of morphine milligram equivalents (MME).

She could not define such vague concepts as “overprescribing” and “highly addictive” or define what a “pill mill” actually was. Interestingly, after the first defense attorney was finished, Ms. Campbell tried to actually leave the witness stand and walk out of the courtroom. Judge Stephen Murphy III abruptly told her that three more defense attorneys needed to cross-examine her, much to her chagrin.

Ms. Campbell’s characterization of the pain center as a “pill mill”, which was intentionally elicited by the prosecution, was directly contrasted by the prosecution’s opening statement, which claimed that the physicians at the Pain Center USA were intentionally underprescribing FDA-approved opioid medication so as to “fly under the radar“ of law-enforcement scrutiny.

Never mind that all scheduled prescriptions in Michigan are reported to the Michigan Automated Prescription System (MAPS), the state’s prescription drug databank PDMP.

Interestingly, Miss Campbell’s testimony directly contrasted to the prosecution’s narrative and was reminiscent of Orwellian doublespeak. In the case of this particular prosecution, the department of justice wanted its cake and eat it too.”

President Joe Biden plans to nominate another Michigan prosecutor to the U.S. District Court for the Eastern District of Michigan, Brandy R. McMillion, the White House said Wednesday. Since 2015, McMillion, 43, of Troy has served as an assistant U.S. attorney in the U.S. Attorney’s Office for the Eastern District of Michigan. She was appointed chief of the office’s General Crimes Unit last year.

THE SILENT EVILS AND perceived WICKEDNESS OF AUSA BRANDY MCMILLION

Zina was Dr. Bothra‘s long time office manager/business manager and personal friend. And Dr. Bothra was incarcerated, she stepped in to help manage some of his business affairs.

That included collecting rent from his properties, paying bills, etc. This also helped take some pressure off of Mrs. Bothra. One day, she was contacted by the AUSA Brandy R. McMillion office. They told her that by doing this she was helping a “criminal” and that they had put a restraining order on her.

BRANDY R. MCMILLION’S SUBJECT MATTER COCK-SUCKERS

Dr. Hersh Patel, the undercover physician in the group who was recording Dr. Lewis for the prosecution and FBI, accidentally recorded himself referring to the patients who sought care from the pain center as “ghetto”. That came out in court last week.

And here you have Hersh Patel MD, straight out of his pain fellowship training, telling elderly folks that they can be arrested for taking their physician-prescribed FDA approved opioid

Lewis’s defense team told the jury during closing that he actually was grateful to Dr. Patel because his 9.5 hours of secret audio actually helped illuminate a day if the life of Dr. Lewis. And then he went on and used the audio to illustrate the wonderful care Lewis was providing. And then there was FBI special agent Claudia Link and Stephen Osterling

Link and Osterling were part of the FBI Detroit team participating in the investigation. They were in court every day but the lead FBI investigator mark Kroger was 100% absent mysteriously. The defense lawyers suspected it was because the FBI paid the undercover confidential informant $16,800 in cash to try and set up the pain doctors despite knowing the fact he was actively using crack cocaine

HHS OIG Brian Tolan staked out the pain center from the parking lot and took photos of the building. He told the jury that the parking lot was packed and there were lines of people out the door, but the photographs he used showed an empty parking lot and only one solitary person walking outside the pain Center. This was demonstrated on cross-examination and completely discredited his testimony.

MEHETA CREDENTIALS

Testimony from both special agents  Brian Tolan and Claudia Link were clown shows.  Both of them were humiliated on cross-examination. Agent Link could not define what a pill mill was and could not define what red flags actually were 🤣

FBI special agent Claudia Link was repeatedly observed prepping prosecution witnesses in the hallways, elevators, and courtroom gallery. 

She also discussed “red flags” on the witness stand but didn’t know what MME was.

Pain physician Hersh Patel MD captured authoring fraudulent EMR note with “cut and paste” medical history. He documented a physical exam that never happened. Also documented advising patient about risks of opioids, risks,alternatives etc. etc that never actually happened.

During the Pain Center trial, undercover physician rat Hersh Patel used a tape recorder to record the other doctors but accidentally recorded himself, confusing the elderly patients, saying they could possibly go to jail for using the opioids prescribed. Also called patients ghetto.

It was unbelievable. The prosecution was clearly overmatched & unprepared. They were shocked it went to trial and that the doctors did not respect them or take a plea. The entire 7 week trial was essentially the doctors teaching them about the specialty of chronic pain medicine.

Opiate addiction is not caused by physicians who prescribe opiate pain medication or by pharmaceutical companies that make opiate pain medication. It is caused entirely and solely by how the opiate medication works in the body. This medication attaches to opiate receptors in the brain and body and is detoxified by the liver. This process has nothing to do with the milligram (MME) dose or whether it is a short-acting or long-acting medication. It is the physiology of all opiate medication, legal or illegal. An environment has been created where proper care and treatment have been threatened.
