THE WAR AGAINST PATIENTS IN PAIN
Several years ago, the state and federal governments reported that pharmaceutical companies and physicians were responsible for the opiate epidemic and the rising number of overdose deaths.
Before this, the government blamed drug cartels and street drug dealers for the increase in drug abuse in the United States. Going after these individuals was part of the “war on drugs.”
Since the “War On Drugs” was a total failure, the government had to devise a new strategy to save their jobs. After all, why would Congress continue to fund them if overdose deaths continued to rise?
In 2015 the CDC issued a report on fentanyl overdose deaths. They did not separate illicit fentanyl from prescription fentanyl. Pharmaceutical companies were accused of being the supplier of the fentanyl that was causing drug overdose deaths.
DRUG DEALERS WITH WHITE COATS???
Doctors who prescribed these medications were now portrayed as street drug dealers and distributors of this medication to the public. Finally, the government had a new target to use in its failed “war on drugs. ” They then used the Controlled Substance Act as a tool to bring criminal charges against healthcare providers.
Law Enforcement, Prosecutors introduced in legal writing and Courts Junk Science supported by No Clinical foundation with terms such as “Over-Prescribing,” “Highly addictive,” “Morphine Milligram Equivalent, and “Red Flags.”
Large Law Firms then ran with it and began to enrich their coffers using the Biog Tabacco settlement model. They then brought multi-million dollar lawsuits against Pharmaceutical companies “Big Pharma.”
Healthcare providers went to jail. Chronic pain patients denied their life-saving medication went to the streets for relief, overdosed, and died. Other chronic pain patients committed suicide. These events were ignored. The government task forces formed to investigate, arrest, and incarcerate innocent healthcare providers successfully obtained plea agreements from healthcare providers who had been stripped of their ability to practice and thus could not pay for competent legal representation.
Recently Deputy Attorney General Kevin A. Polite,MGHW, who previously stated that physicians prescribed “illicit” medication announced the formation of a new task force in New England to go after healthcare providers. Government agencies need to be subjected to congressional oversight.
Only then will the real reason for overdose deaths be reported. Only then will healthcare providers be allowed to do their job and be instrumental in reducing drug overdose deaths.

Then the unthinkable happened. In Santa Barbara, California, and Oklahoma, judges ruled that pharmaceutical companies were not a nuisance and were not responsible for the opiate epidemic.
On June 27, 2022, the United States Supreme Court voted 9-0 and reined in overzealous prosecutors who arrested doctors for treating their patients as individuals rather than conforming to law enforcement’s accepted standards.
That a physician could not be charged with a crime for prescribing a controlled medication they were authorized to prescribe. While these were much-needed victories, the government, except for Dr. Donald Hyungjoon Kim, M.D., case in Oklahoma, has not moved to exonerate the thousands of healthcare providers who were falsely accused.

However, Apparently, the Department of Justice didn’t get the memo. On June 29, just two days after the Supreme Court’s Ruan ruling, AUSA Kenneth Polite, MGHW, of the DOJ announced the formation of the New England Prescription Opioid Strike Force, targeting doctors who law officers decide are “overprescribing” opioid pain medications.
What can we do now to reduce overdose deaths?
You start by establishing goals. Mine are to legalize drugs and decriminalize the health care system. We must recognize that you can’t prevent addiction.
1. Lifelong treatment with adequate doses of Suboxone and Sublacade is essential.
2. Remove the DEA and DOJ from all matters concerning treatment, and all Control Substance Registration certificates authorizing prescribing, dispensing, and manufacturing must be licensed by the US Surgeon General Office and FDA.
3. Release and restore those healthcare providers who have been arrested and incarcerated and denied their ability to practice medicine.
