Memphis Gynecologist Receives 20-Year Sentence Despite 40,000 sterile biopsy device inventory.
Court documents and trial evidence indicate that certain media accounts of the case against Dr. Sanjeev Kumar, MD, a Mayo Clinic-trained robotic gynecologic oncologist, contain significant inaccuracies. Claims that Dr. Kumar performed more than 15,000 procedures with “adulterated devices” on Medicare and Medicaid patients are not supported by the data presented at trial. The government-produced datasets contained no patient identifiers and offered limited accountability. One exhibit attributed procedures to patients who never existed at Poplar Avenue Clinic. Prosecutors also counted denied, crossover, and rejected claims, as well as clerical insurance errors, as “procedures,” inflating the numbers cited in some reports.
Sterile Single-Use Devices Used for Biopsies
Endometrial biopsies at the clinic were performed with single-use sterile endometrial pipelles. Clinic records document the purchase of more than 40,000 of these disposable sterile devices. Multiple witnesses testified that a new sterile pipelle was used for every biopsy. The jury was not asked to evaluate the use of any specific device on any specific patient. A Remmer hearing for a tainted federal jury was ordered.
Hysteroscopes Reprocessed According to FDA and CDC Guidance
Dr. Kumar and Poplar Avenue Clinic purchased more than 30 multi-use hysteroscopes and accessories cleared by the FDA. Defense evidence showed these instruments were reprocessed according to CDC and FDA guidance for high-level disinfection, the accepted standard for office-based hysteroscopy. High-level disinfection is permitted under the devices’ Instructions for Use. Metallic devices were sterilized in autoclave.
Expert Testimony Issues (Subject Matter Cocksuckers aka-SMCS)
• Government expert Dr. Matt McDonald, compensated at $750 per hour, did not perform in-office hysteroscopy yet was admitted as an expert.
• Dr. Jona Bandyopadhyay, Deputy Chief Medical Officer for TennCare, had not seen patients in a clinical setting for more than five years and had been recommended by the Tennessee State Medical Board for a re-entry pathway or administrative license.
• Government witness Dr. Ben Abdu testified that insurance companies were “the real criminals,” acknowledged reusing single-use devices himself, and stated he did not believe his own device use constituted a crime. He received immunity and later joined a competing Memphis clinic.
FDA Testimony and Evidence Handling
Court documents indicate that FDA lead reviewer Poulomi Nandy provided testimony suggesting the agency had never cleared a hysteroscope for high-level disinfection, a statement contradicted by existing FDA documents. An FDA agent assigned to the case destroyed evidence from his phone, and the lead reviewer later left the agency.
Condition of Devices Presented at Trial
Devices shown to the jury had been held in FBI custody for more than a year under unsanitary conditions. Many were broken, non-functional, or were cystoscopes rather than hysteroscopes. Several contained built-in features designed to prevent reuse.
Independent Review by Tennessee state medical board
A comprehensive investigation by the Tennessee State Medical Board found no wrongdoing. No other clinicians who performed more than 1,000 procedures at Poplar Avenue Clinic were charged.

Refusing to abandon his purpose, Dr. Tennant spent his remaining years turning his foundation into a scientific “lighthouse” for abandoned patients. He wrote affordable handbooks to guide other doctors and patients, personally answered letters of distress, and hosted weekly Thursday night support video calls with patients nationwide. He kept hosting these support calls right up until his death, even running them from his hospital bed with his wife, Miriam, by his side.
