REPORT FROM DR. MARK IBSEN:
PHARMACIST ANGELA
I had a problem today with a pharmacist, Angela.
Diana Rumley and Maria Forman are both without their medicine.
Angela claims that this is my fault!
Said the patient should be treated in ER or A methadone clinic.
She seemed to want to project on me that it’s my fault that these patients are on these high doses and that I should’ve planned better for them.
She seems to be on Some type of campaign.
Initially, she claimed that the Covid emergency guidelines that I’ve been operating under were not valid. Then she said I should’ve planned better even though the guidelines have been in place through 2026.
She also seems to be unaware that the guidelines have been extended yearly for the last four years.

The patient was seen in person on May 12.
Maria has been in bed for the last two weeks while waiting for a pharmacist to approve her prescription.
I’m going to be seeing Maria in person again on June 2.
For Diana, i sent in a new rx today, and the pharmacist refused to fill it because it didn’t have a fill by date on it.
It has always been my understanding that when I send in a new prescription it should be filled in a timely manner
Neither of you are available this afternoon. I look forward to speaking to you on Monday. I asked Angela to be sure that the conversation we had was recorded and she assured me it was.

To: John, Esq.,
I’m copying you on this because I’ve not heard anything from the pharmacist at Anazao Health regarding the letter. I asked you to send them. I think the patients are going to need to band together and get an injunction.
There is no other source in the country for injectable hydromorphone that Anazao Health provides. I believe that if the DEA is pressuring Anazao Health to change their policy, they are operating in violation of the Chevron doctrine.
Dear Calvin:
Just hot this from Diana Rumley:
“ Hey Dr. Ibsen
Anazao Health called me to let me know they deleted that prescription you sent over to them saying that the script did not follow the guidelines they need to process the script. The prescription must be written for 3 months, and each one has to have the last seen in person on the prescription and a fill-on date on each prescription. They said they sent you an email… I am trying to have it delivered by tomorrow, Saturday 5/31/2026. so can you fix the prescription and send it to them so it can be taken care of… I told them what else they needed? MY DNA NEXT? So frustrating! Everything was fine this morning when I called. Now this.”
I have communicated previously that I’m not comfortable writing three months worth of prescriptions for each of my hydromorphone patients.
One month at a time.
Last visit noted
Thank you
PS:
Two patients have already had their prescriptions filled, and this one arbitrarily is requiring three months. Please get the story straight and let’s be consistent for the sake of the patients and their care.

Dear All,
I have to take a moment to thank each and every one of you who participated in the NIH request for public comments regarding priorities for research and for allocating research dollars toward the issues of pain.
I know the request came in last minute, and then their website failed completely with their SUBMIT button not functioning. Many of us had to pivot after completing the whole form and then move all that information to an email – and we all did!
None of this was easy – answering the questions, getting the form filled out properly, finding out the site was down, finding the correct email address and figuring all that out, and then getting it in before the midnight deadline. That was all really complicated, but you all rose to the occasion! ![]()

I think we submitted thousands of comments. I think they likely anticipated less than 30. Yet I think we did at least 1,000, if not a great deal more than that.
My heart is full of gratitude towards the multiple people who took leadership roles in other groups and organizations and who jumped into this project immediately. They took on the jobs of promoting and explaining the steps, writing example letters, encouraging their friends and other patients, and wrote sample letters for other people to use. They provided instructions for how to file, and then have to rapidly switch to email once we saw their website was down. This was a phenomenal leadership response, as well as an incredible number of people who reached out and helped others individually.

I want to thank each and every one of you who participated in this effort. You are the heroes of the challenges we’ve faced over these last ten grueling years, and you’re still standing and working for change for all.

You are an outstanding community and I’m truly so humbled, honored, and blessed to be a part of it. Thank you all so much. ![]()

I promise to get back to all of us as soon as I hear the impact of the work we did. It might take a few months, because the government moves slowly, but we will find out what the responses were in a little while. Then we will be able to track the NIH, where they put the research money, if they listened to us, and now – we will have a means of holding them accountable.
None of this would’ve been possible without all of you.
With all my gratitude, to everyone,
Andrea

RAILROADED THE STORY OF DR. NORMAN J CLEMENT, RPH, DDS, PRONTO PHARMACY, TAMPA, FLORIDA

Thank YOU for getting the word out and walking us all through it! With all the “in” or “out” fighting with groups, I was so happy to see everyone working together from different angles to get this done. Imagine if we could ALL work together ALL the time??
Thank you. Again- it was complicated. I don’t have the medical/technical language to make pertinent and efficient comments on my own, so having a template and technical answers to their questions, and THEN knowing so many people also had trouble submitting and were using your detailed directions to email it? Well, I went from giving up in frustration to getting it emailed and hopefully counted!
Thank you so much, Andrea. We have been disappointed so many times, but I will stay hopeful that some response will be made to our input. I was so relieved when I was able to successfully hit submit!!!! Let’s pray from some action on their part. Thank you again for bringing this to us
Thank you for posting the RFI! I wouldn’t have seen it with my workload, and the only reason I was even on social media was that I have the flu and couldn’t work. I wouldn’t have seen it otherwise. Let’s talk soon. Maybe we can figure out a way to post these RFIs by priority to all the pain groups or a mailing list so people don’t miss them.
CURBING D.E.A. OVERREACH INTO MEDICAL CARE
Conclusion:
The Mandate for Constitutional Restitution
The current state of regulatory jurisprudence allows for what Richard Epstein calls “Regulatory Tyranny.” The administrative state is being utilized to achieve redistribution and professional exclusion without paying the constitutional price. We must close the “Police Power Loophole”; the authority of the state (Lech v. Jackson) must not be allowed to “swallow the rule” of the Takings Clause.

The Mandate for Reform:
Restore Lingle: Courts must recognize that even a valid exercise of police power can “go too far” and necessitate compensation under the Fifth Amendment.
Abolish the NPDB: Systems that shield private defamation behind federal authority and bypass constitutional due process must be dismantled.
INTANGIBLE PROPERTY
The Fifth Amendment is the final defense against an unaccountable “Shadow Regulatory Environment.” We must resist any doctrine that treats the government’s ability to diminish property value as an inherent right. Restoring the Takings Clause is the only way to curb the aggressive, unaccountable overreach of the administrative state.

So it was that the bison came upon a family of mice who were all sick, but they had nothing with which to pay for the doctor’s aid. “But without my care, your children will die. I must help, it is my duty,” he said.
Without a thought, the doctor gave them his aid, one after the other, and each mouse he healed was grateful. Soon, however, he began to tire and eventually became exhausted, yet still more mice came. “Surely, though, this deed will be worth it in the end,” he thought, and strengthened his resolve.
