Hello to all! We’re enjoying a beautiful sunny day in Virginia and I hope it’s nice wherever you are. Sorry I haven’t updated in a while, but my time has been well spent. During the week before last, I was doing admin work in support of John Flannery while he was writing our petition for a re-hearing en banc (with all 15 of the Appeals Court Judges).
You may recall that the 3-judge panel criticized us for not having the intervenors’ statements notarized, so we asked each patient intervenor to get their statements notarized this time to be submitted with the petition. John drafted personalized statements – one for each intervenor – and sent them to me to distribute to the patients, collect them once notarized, and get them back to him.

We got it done in less than a week … 9 patients in 6 states spread across 6 time zones! The petition, notarized statements, and appendix were submitted on time to the Appeals Court on Friday, April 5, 2024.
John called to ask the status on Friday, April 12 and he was told he should proceed to get 19 hard copies prepared and submit them to the Court asap. The copies will be submitted tomorrow or Tuesday.
We hope that all 15 judges will read what we’re submitting and that we will get a positive outcome this time!
Finally, we come to Xiulu Ruan v. United States. I have written about Dr. Ruan before, but briefly, two physicians had been prosecuted for being “outside the usual practice of medicine” and prescribing controlled substances “without a legitimate medical purpose.”
The court basically instructed the jury that the doctors’ subjective belief that they were acting in good faith didn’t matter if the government was able to persuade them that the doctor’s practice deviated from the “norm.”
What is this norm? I’ve written on this subject also. It simply does not exist. After their conviction and on appeal, Dr Ruan and his colleague ended up in front of the U.S. Supreme Court. And the doctor’s absolute good faith efforts meant nothing.
This did not fly with the Supreme Justices, who immediately saw the flaw in the government’s argument, stating that the law was ““ambiguous,” written in “generalit[ies], susceptible to more precise definition and open to varying constructions.”
