It is past time to move the mission of medical Control Substance Registration and licensing from Cops to clinicians from the Department of Justice, specifically the United States Drug Enforcement Administration (DEA), to the Office of the United States Surgeon General. Law enforcement has absolutely no business in the practice of medicine and the dictation of medical protocols.

Most importantly, a Petition filed on April 28, 2023, to the FDA by the Center for US Policy Study found DEA’s NarxCare and PDMP monitoring deem:

“…the Bamboo Health (“Bamboo”) NarxCare software a misbranded device and take administrative action to prevent serious, adverse health consequences and death.”

The study reported NarxCare does not satisfy FDA’s 520(o)(1)(D) because to the extent it could be construed as incorporating data from a clinical laboratory or other medical devices, the software is intended to interpret or analyze PDMP and non-PDMP data to produce predictive risk scores for Substances Use Disorder’s, (SUD’s), including the disease of opioid use disorder.

Narxcare is operated by the DEA and not any facet of the Healthcare entity. The DEA is not under the DHHS; it is under the DOJ. In a recent article, “The Misinformed & Misguided Prescription Abuse Prevention Act: A Response to one DEA Law Enforcement Advocate Loyola Marymount Law Professor Rebbeca Delfino,” by Robert Capodilupo and Jacob James Rich, published in “Yale Law and Policy Review” — Inter Alia (Spring 2023), the authors pointed out that, while opioid prescribing has declined over the past decade, total opioid deaths have skyrocketed because of a spike in illicit opioid overdoses.

They cautioned that Delfino’s proposed Prescription Abuse Prevention Act may create a harmful “chilling effect,” further deterring physicians from prescribing needed pain medicines to treat patients.”

Capodilupo and Rich also explained that the drastically increased opioid mortality over the past few years was mostly due to illicitly manufactured fentanyl, not prescription fentanyl, noting that, by August 2017, the CDC had formally removed fentanyl from the definition of prescription opioid mortality.

They predicted that a further reduction in opioid prescribing might exacerbate opioid overdoses by orienting pain patients and recreational users to illicit alternatives such as heroin and illicit fentanyl.

Walter F. Wrenn, III, MD, a Philidelphia Physician of some 45 years whose medical practice was attacked by DEA and State law enforcement authorities, wrote in a recent article:

The Medical Community, continues to report data concerning addiction and successful treatment. It is obvious from data from Europe and Canada that our approach to the laws and treatment are not successful. The deaths from opiate overdoses are increasing in the US and decreasing in other countries.

What is the reason?

Drugs are illegal in the US. Treatment for SUD is only available at methadone clinics and physician offices certified to prescribe Suboxone. Individuals and governments reject fentanyl test strips and clean needle sites.

In Europe and Canada, drugs have been decriminalization. The Medical Community, in conjunction with governmental agencies, has set up clean needle sites. They have fentanyl test strips. They prescribe opiate pain medication for those addicted to opiate pain medication.

They supply heroin to those addicted to heroin. They also make Medication Assisted Treatment or harm reduction readily available without restrictions. If we are to make a difference in decreasing opiate overdose deaths, we must adopt successful treatments.”

THE DEA HYENA TARGETTING HEALTHCARE

TARGETING PACKAGE ending the DEA Mission

Jay. K. Joshi MD, a DOJ-DEA victim himself so, articulates the succinct observations of a growing majority of data researchers, healthcare providers, scientists, and patients suffering pain whose diseases are being criminalized:

When a disenfranchised person lashes out or complains, the societal response is to discredit that person. It’s instinctive. Think of the person affected by poverty who lashes out against corporate greed: a story as old as time. Or the scorned lover who decries all relationships: we have entire libraries filled with such stories. How often have their cries been ignored?

Complaining about the unfairness of it all feels good – as I must confess – but it does little to change the narrative and stop the abuses of the powerful. Only a well-constructed argument can do that. We have one already. It’s the clinical data. Study after study has exposed the failures of the DEA and the CDC opioid prescribing guidelines. But the voices expressing as much appear to fall on hollow ears. So in silence, we react.

But the thing is: they hear us loud and clear. They just know that by not reacting, we will react. They’re playing a veritable game of chicken, using silence to conjure a response. We think by reacting to their silence, we’re calling attention to their abuses. They know our reactions destroy our credibility. It’s self-defeating fool’s gold. You’re only fooling yourself if you think such efforts are valuable.

Instead of complaining about how corrupt the DEA is, we have shown how the DEA is incapable of adjusting to clinical data, which suggests their efforts are counterproductive.

Instead of pointing at the outsized voices of a limited few in the CDC, we have revealed the undisclosed conflicts of interest that would invalidate their policy recommendations.”

THE SCIENCE, MATH, AND LITERATURE ARE WITH US

The science is with us. The clinical data consistently proves us correct. We must stick to the message, regardless of whether we feel we are speaking into an eternal void. It’s frustrating, maddening even. Believe me, and I share your sentiment. But it’s the most effective way to fight. More importantly, it takes away their strongest weapon.

The overdose crisis is a modern manifestation of the ongoing war between power and science. It’s no different from what Galileo experienced centuries ago. Throughout history, the ones who were successful were those who never allowed the powers that were to discredit them.

They crafted simple messages in respectful ways. It was their simplicity that made them so effective. Funny how that works: Power is only effective against those who lash out against it. But it’s powerless against those who stand up to it without reacting.

  1. I see employees and administrators of the DEA as a school of piranhas or sharks, not hyenas. They sense blood in the water and they are in a frenzy. All sense of Justice, compassion, and common sense is gone. All they “see” is the appearance of crime from their viewpoint.
    It is rather sad. The DOJ needs to reel in the department or disband it before it destroys American Healthcare as we know it across the board and that includes the socialized elements we have as well.

  2. The DEA is a Cancer on societies butt. They haven’t done their job since they started and are getting farther off track. They should slowly be defunded and completely erased until they can show what their real job is and stick to it! They are an exorbitant
    expense at a great cost to health of extremely desperate sick people who did and are work hard for their place in society in sickness and health!!!!
