THE REPORT THAT WAS NEVER READ
For at least the last two decades, doctors have been targeted and attacked by the United States Government, specifically the Drug Enforcement Agency (DEA) and the Department of Justice (DOJ).
Both of these agencies have worked in concert to pursue doctors for what appears on its face to be financial gain. As with most scandals, investigations, or targeted attacks, following the money is usually where the answer lies.
These attacks are no different. The policing of the practice of medicine is not a Black and Brown problem but a green problem.
Other doctors have been targeted and terminated by their employers only to be unjustly reported to the National Practitioner Data Bank, permanently ending their medical careers.
This problem came to light after a series of broadcasts produced by Angela Greene on WAOK Radio in Atlanta, Georgia, revealed that an alarming number of doctors were being sent to prison for practicing medicine, specifically Medicaid fraud and overprescribing.
The imprisonment of countless doctors has had a devastating effect on healthcare, as it diminishes the availability of physicians to service the communities that depend on them for care. This is a problem we cannot ignore.

Executive Summary:
In our request to write this Bill, The Protection of American Medicine (hereafter referred to as the PAM Act), to address the criminalization of Black and Brown doctors, we realized the problem was larger than just Black and Brown doctors and included all Physicians, Dentists, Pharmacists, and Nurse Practitioners.
A collaborative team wrote the PAM Act of advocates, pain patients, attorneys, pharmacists, and healthcare practitioners who have been indicted, imprisoned, and/or suffered life-threatening consequences because of regulatory overreach regarding the practice of medicine.
Those affected have provided a first-hand account of how they were targeted, attacked, indicted, and imprisoned. They offered details on how their assets were seized/forfeited, sometimes without them ever being formally charged. Those assets, funds, and property were never returned to the rightful owners.
Objective:
The goal of the PAM Act is to restore the practitioner-patient relationship by creating an agency that will oversee and regulate the practice of medicine and return that practice to medical practitioners, permanently eliminating the influence of law enforcement, specifically the DEA.
Scope and Method:
The PAM Act will be enacted based on two existing legal precedents: (1) 42 USC 1395, which prohibits federal interference in the practice of medicine, and (2). Codifying the Ruan Rule originated from Ruan vs. the United States (affirmed by the 11th Circuit). This offers two well-established defenses to be used by practitioners to avoid further harm, the good faith defense and/or that a practitioner is acting in the legitimate course of medical treatment.
