THE OFFICIAL ROLE OF DEA IS CONTRARY TO THEIR ACTIONS

As a law enforcement agency, DEA is not in a position to authorize or dictate what a doctor prescribes to a patient. DEA cannot grant waivers of any kind when it comes to the practice of medicine because no sick waiver exists. 

As the United States competent body charged with managing controlled substances and chemicals for scientific, medical, research, and industrial applications, DEA regulates the flow of controlled substances, not the practice of medicine.

Congress determined Federal law enforcement agencies are unqualified to determine whether drugs “have a useful and legitimate medical purpose and are necessary to maintain the health and general welfare of the American people.” 21 U.S.C. § 801(1).

A USA Federal jury found Dr. Qing McGaha, MD, guilty of 14 counts of unlawful drug distribution, four counts of money laundering, and one count of filing a false tax return, United States Attorney Roger B. Handberg announced.

The regulation at the heart of this case, 21 C.F.R. § 1306.04(a), provides: “A prescription for a controlled substance to be effective must be issued for a legitimate medical purpose by an individual practitioner acting in the usual course of his professional practice.” 

Leo Beletsky, Law Professor at Northeastern University Law School, calls the government crackdown on prescribers getting targetted low-hanging fruit. According to Leo Beletsky and Jeremy Goulka September 2018 article, “The Federal Agency That Fuels the Opioid Crisis,” in the New York Times: “The Drug Enforcement Administration, the agency that most directly oversees access to opioids, deserves much of the blame for these deaths. Because of its incompetence, the opioid crisis has gone from bad to worse. The solution: overhauling the agency, or even getting rid of it entirely.”

Leo Beletsky of Northeastern calls for the government crackdown on prescribers getting low-hanging fruit. “The DEA measures success based on the number of arrests and prosecutions. Doctors are minor players. The DEA convicted two hundred sixty-three physicians on charges between 2003-2017, and over 3000 were forced to surrender their licenses.

They create their targets. Who is the biggest prescriber in a region, state, and nationwide? They are investigated. Who does the most procedures?

They use ‘flags’ like distance traveled, forgetting that by disincentivizing and terrorizing prescribers, there is no one left to prescribe, and patients must travel farther for the same services.  The flags created during the pill mill era are now self-perpetuating. If you mine data enough, you might find something, and law enforcement can access data without individualized suspicion, probable cause, or any judicial review.”

Just to be clear, I am talking about cancer patients, trauma patients, and chronic pain patients with genetic syndromes that they were born with, and then there’s the depression because they truly suffer due to all these laws. What they are doing is inexcusable!”

JUDICIAL MUNCHAUSEN BY PROSECUTION (MSJP)

While much has been made of the fact that law enforcement (DEA, FBI) uses paid informants to snare pain physicians Munchausen’s Syndrome thru Judicial Prosecutions (MSJP) defines exposing the DOJ-DEA targeting of Doctors and the issues of entrapment is of the same mindset and nearly identical to the disease state Munchausen’s Syndrome by proxy (MSBP). 

Described as a mental health problem in which a caregiver makes up or causes an illness or injury in a person under his or her care, such as a child, an elderly adult, or a person who has a disability.“

Because vulnerable people are the victims, MSBP is a form of child abuse or elder abuse. Similarly, Munchausen’s Syndrome thru Judicial Prosecution (MSJP) DEA law enforcement “makes up an illness,” using a person under their control.

Doctors targeted for “investigation” are publicly raided, have their financial assets seized, and have their medical licenses and registrations to prescribe controlled substances suspended when criminally charged. 

With their assets seized, unable to work, and facing charges that can carry many decades in prison, doctors are routinely pressured into accepting plea agreements requiring them to give up their seized assets. 

Those assets are then split between Insurance Companies and the law enforcement officer’s agency: “restitution” to Third Party Providers (and their “PBMs”) and “asset forfeiture” to the agencies.

PAIN AND THE RULE OF LAW

The question here is the Rule of Law. The most fundamental concept of our country; without it, our society crumbles. This allows an agency to take anything they want unchecked based on their own manufactured rules and misinterpretation of laws, and medical procedures guidelines, creating their science and facts.

The great fear here is that the United States Drug Enforcement Administration (DEA) has operated unchecked as a rogue sub-agency of government operating outside the rule of law. Creating their own medical science (Auer deference), seizing property using the omnipotent authority of ill-gotten gain over the field of medicine and medical science.

Specifically, misidentifying the dosages and purposes of legally and medically prescribed FDA-approved Narcotic Analgesic medications, “having a useful and legitimate medical purpose,” to be illegitimate. The Supreme Court reined in overzealous prosecutors who arrested doctors for treating their patients as individuals rather than conforming to law enforcement’s accepted standards. In Ruan v. United States, the Court overturned a decision that would have sent board-certified pain management specialist Xiulu Ruan to prison for 21 years for not conforming to law enforcement’s arbitrary and misguided standards.

  1. I would like to have a link to the document in the data analytics section that explains how the DEA targets doctors using this info. I think my pain doctor needs to see it. I regularly print documents to protect her, because without her treatment, I would not want to live. She gave me my life back by properly treating my mangled spine. My next step is neck and back surgery – risky, but better than being a quadriplegic!
