DEA’s, “REQUESTED RELIEF” Pre-hearing Statement, October, 2019

In Oct 2019 DEA REQUESTED RELIEF. ” that Respondent’s DEA Certificate of Registration No. FP2302076 be revoked, and any pending applications for renewal or modification be denied, on the grounds that its acts have rendered its continued registration inconsistent with the public interest under 21 U.S.C. §§ 823(f) and 824(a)(4). “

The argument the DEA clearly lacks legal foundation and is solely based on “GOOGLE MAPS” reviewed by DI Richard Albert to determine the suspension of Pronto Pharmacy’s DEA certificate. 

 The questions are:

1. Each patient has  legitimate prescriptions, for a specific disease state, a physician patient relationship, so “at what mile marker on GOOGLE MAPS, did the physicians diagnoses, and patients prescriptions become illegal and the patient engaged in abuse of their medications. 

Are we now judging people by the mile maker??? I got sick in Johannesburg, South Africa, and needed Cipro to treat the diarrhea, Pharmacist Tabo at Click’s Pharmacy, made a clinical judgement, without using GOOGLE MAPS, to service me (see video)

2. At which mile marker on “GOOGLE MAPS” did their medications become drugs and what proof does the DEA have that these patients abused their medications or engaged in diversion.

3. At what mile marker on “GOOGLE MAPS” did Don Sullivan examine each patient or ordered additional radiographic to overturn the prescribing physicians diagnoses. What Blood work did he request and what are his qualification to conduct such re-examination of both the patients and their physician diagnoses to further establish that: (see url attachment ii.)

a. these prescription were illegitimately written.

b. Prescription were intended for diversion.

c. Physician diagnoses and Chronic Disease state was false wherefore the both physician and pharmacist filling these prescriptions in their co-responsibility engaged in fraudulent mis-diagnoses, and conspiracy to fraudulent practice medicine and  both were engaged in healthcare fraud.

4. Most -importantly is there any literature with current existing law  that  supports “GOOGLE MAPS” as a legitimate instrument use in a court room to establish “prescription medication abuse” or drug diversion.

Further I’ve been practicing pharmacy for nearly 45 years and have never use or heard of any Pharmacist using Google maps to establish the legitimacy of any Prescription. Judging people by the mile maker, well I’m grateful for Pharmacist of Clicks Pharmacy in Johannesburg, South Africa (see video).

 I have filled many prescriptions in my years and have filled prescriptions from patient from all over the world seeking treatment. Where is the law  that requires GOOGLE MAPS to be used as the determinate soley for  pharmacist as a factor in treating a patients?

“DOES, DEA’s “GOOGLE MAPS” APPLY ONLY TO PHARMACIST OR DOES IT APPLY TO DENTIST, PHYSICIANS, NURSES, NURSE PRACTITIONER OR WHOM WITHIN THE MEDICAL PROFESSION?????????”
