THE LEGAL MEDICAL DEFENSE OF DR. MARK IBSEN, MD

These documents outline a legal and medical defense of Dr. Mark Ibsen regarding his treatment of a chronic pain patient, Jerome Belling. The records address two formal complaints filed with the Montana Board of Medical Examiners, which allege that the physician engaged in inappropriate opioid prescribing and that the patient suffered multiple overdoses.

In response, Dr. Ibsen’s counsel argues that the high-dose hydromorphone injections were medically necessary for a patient with degenerative disc disease and a history of numerous surgeries. The defense further asserts that the reported overdoses were actually misunderstandings by the patient’s family and that the medication significantly improved the patient’s quality of life.

This response demonstrated that Dr. Ibsen acted in full accordance with established medical principles, supported by expert opinion and medical literature, and consistently in the best interest of his patient. The complaints, therefore, lack any factual or medical basis and must be dismissed. To properly evaluate Dr. Ibsen’s medical judgment, it is essential to first understand the dire physical and emotional condition in which Mr. Belling presented for care.

Any evaluation of Dr. Ibsen’s treatment is meaningless without a complete understanding of Mr. Belling’s debilitating medical history and the state of acute suffering in which he presented for care on or around February 17, 2025. This context is not merely background; it is the foundation upon which every clinical decision was made.

Prior to resuming his care with Dr. Ibsen, Mr. Belling was in a state of medical crisis. Diagnosed with “degenerative disc disease” and having endured “a total of seven back surgeries,” he was a man defined by decades of pain.

For approximately 20 years, his condition was managed by his previous physician, Dr. Weinert, with a stable prescription of Oxycodone 120 mg a day, establishing a significant and long-term opioid tolerance.

However, for the eight months immediately preceding his consultation with Dr. Ibsen, Mr. Belling had been without any pain medication, leaving him in a state of “chronic unremitting pain.”

He presented to Dr. Ibsen while hospitalized at Eagle Manor, an assisted living facility, where he was on oxygen and recovering from pneumonia. His vulnerability was compounded by acute personal distress, exemplified by the fact that his brother had sold his dog during his hospitalization.
