These kinds of disparities have appeared in Federal Courts across the country in cases against medical providers, despite concerns raised by the American Medical Association, Pain Care advocates, and, in this case, fire science evidence—the NFPA 921 guidelines—which establish the scientific method as the gold standard for investigating fire origins and causes.

Beety and Oliva argue in the field of fire science that cognitive biases, such as tunnel vision, and the misuse of the “negative corpus” theory, continue to influence arson cases, and infer that these concerns extend to other cases, and that such patterns have become accepted as a judicial norm.
