By coordinating selective enforcement of the Controlled Substance Act, HFPP prevents those physicians from practicing medicine in a race—or gender-neutral manner. Under the “State Involvement Doctrine,” such behavior is improper because the software scheme violates the 14th Amendment, the Equal Protection Clause of the U.S. Constitution.
