WHAT IS THE TRUTH? WHEN LAW ENFORCEMENT IS ALLOWED TO MANIPULATE MEDICAL SCIENCE
This is an interesting question. What is truth? There is a famous quote: “The truth will set you free.” It implies that to be free, truth is the way. But is that true? Until my arrest on February 17, 2021, I believed that to be the case. Then I was exposed to a system that I was totally unfamiliar with.
I spent 80 years of my life working to improve my life and 42 years practicing medicine taking care of people regardless of race, religion, or financial status. I saw families embrace me even when their loved ones who I was taking care of died.

I cherished the trust that families had in me. I was entrusted with decisions concerning life and death. I lived by the two principles. First ” Do no harm”. Second ” Never interfere with a patient’s faith because that may be the only thing that makes them better”.
..I was also charged with reckless endangerment even though the patient had been treated by me for more than 20 years..
Yet I was charged with Drug Delivery Resulting In Death a law designed to hold “Drug dealers” responsible for the death of individuals they sold drugs to. I was also charged with involuntary manslaughter even though my patient had taken cocaine.
The truth is I prescribed legally approved medication. I am not a drug dealer. I charged the same $75 for an office visit. The patient has been prescribed the same medication including the same quantity and dose for over 5 years.
I didn’t prescribe or supply the cocaine. Cocaine and opiates do not work synergistically. I was also charged with reckless endangerment even though the patient had been treated by me for more than 20 years and as I said before had been on the same medication for 5 years.

After I was introduced to the criminal justice system, I became aware that the truth did not matter. I became a victim of my belief in the truth setting me free and the “deal” which has nothing to do with truth. First after being arrested bail was set at $100,000.00. and had to be paid for my release.

I was treated like a common criminal. I legally prescribed an FDA-approved medication after examining a patient. I didn’t do anything or act in any way that was different than what I had done for more than 42 years of practicing medicine.

The patient took cocaine. The charges however allowed the Judge and prosecution to set bail at $100,000.00.
Because I couldn’t afford bail, negotiations had to take place. I was incarcerated and unable to participate in those negotiations. My daughter hired an attorney and after 8 days I was released on a signature bail of $100,000.00. In order to be released, I had to surrender my medical license, DEA license, and passport and agree not to practice medicine anymore.

My patients were deprived of medical care and 2 patients died as a result of a drug overdose. After I was released from jail, I had to hire an attorney as I was scheduled for a preliminary hearing on March 15, 2021.Not knowing what I was charged with, I hired a criminal attorney.
Upon meeting with him, I saw for the first time a copy of the criminal complaint against me. Drug Delivery Resulting In Death, Involuntary manslaughter, Reckless endangerment, 2 counts of Medicaid Fraud, Falsifying Medical Records.

My attorney informed me that he didn’t know any medicine and would rely on me for that. He read me the statue for each charge. He said that he would ask for a postponement of the preliminary hearing. He then quoted his fee of about $60,000.00. He mentioned that there could be another $40,000.00 in expenses for expert witnesses and investigators.
I of course at that time was penniless and unemployed. Within 2 weeks the prosecutor offered a plea deal. They would drop the charge of Drug Delivery Resulting In Death.
Recommend no jail time and probation and a $2000.00 fine to be paid to the Pennsylvania Medicaid Agency. Also, 6 months of house arrest and I had to agree not to practice medicine anymore.

I was told by my attorney that if I didn’t accept the agreement, I would have to give him more money. I accepted the agreement on 10/20/21. No jail time. 5 years probation. $2000.00 fine. I pleaded nolo contest to 4 charges. The Judge changed my nolo plea to guilty. None of the charges were true.
My attorney didn’t have to prepare the case but he got paid $36,000.00. The Assistant Attorney General didn’t have to prove guilt or innocence but got a conviction. The Medical Board didn’t have to evaluate the medical care of my patient but my medical license was still suspended.
Where was the truth that would set me free?
Lost in the criminal justice system. Where were the checks and balances that prevent the innocent from being falsely accused and incarcerated?

Lost in the system. What I learned was an eye-opening lesson. Truth doesn’t matter. What matters is what lies can one make you believe is the Truth. When investigating the hundreds of cases involving the arrest and conviction of health care providers you will find that the lies told, not the truth, prevailed. The DOJ/DEA and state AG’S paid a tremendous amount of money to buy the lying testimony of their expert witnesses. The lies carried the day.
Again I ask, “What is Truth” and what role does Truth play in the criminal justice system?
This event in my life was predicated on a lie that pharmaceutical companies and health care providers were responsible for the opiate epidemic and the deaths of these innocent addicted white individuals. I say white because when black individuals were dying from heroin overdoses no epidemic existed.

Once this narrative was accepted successful lawsuits were filed against pharmaceutical companies and billions of dollars were awarded to the states. This process has now been curtailed with the recent rulings in California, Oklahoma, and West Virginia.
In addition to pharmaceutical companies, health care providers were arrested, charged, and convicted of committing crimes while practicing medicine. This process has now gotten ammunition to stop the criminal process against health care providers.

The Supreme Court in the Ruan vs US decision has ruled that health care providers cannot be charged with a crime for prescribing opiate pain medication in the usual course of treatment. What had not been recognized from the beginning was that in America if something has value, it will be sold in the street.

There is no physician or pharmacy who has written or dispensed a controlled medication whose medication has never been sold on the street. That’s regardless of opiate contracts or drug monitoring programs. If something has value and an individual who uses it is willing to pay, it will be sold in the street. A good example that people can relate to is the federal food stamp program.
The program went through many changes in an attempt to prevent fraud. They continue to prosecute neighborhood stores that violate the act. Stores that allow prepared food and other items like cigarettes to be paid for by EBT cards(the present food stamp mechanism). They also pay fifty cents for a dollar’s worth of value which they receive when they redeem their EBT invoices.

The greater violation is the selling of this card for use at fifty cents for a dollar’s worth of value. In other words, I will give you my card and passcode which you can use and you will pay fifty cents to me for every dollar you use. This illegal scheme cannot be stopped and is repeated all across America. Every month people who receive EBT cards have individuals standing by to buy them.

As a society, we have to recognize the two Americans. One lives above the property line and exists on money and credit. There is another one that lives below the poverty line and is involved in various activities they don’t consider illegal but necessary to eat, have shelter, have clothes, and other things that if following the law they could not have.

The war on drugs has been a total failure but because of the money associated with this law, it continues to be advocated by the United States Government.
