Who’s In Charge
For years there have been assaults on physicians. In the late nineteen hundreds, the issues were fraud and abuse. They used coding violations to arrest and convict health care providers. Eighty-five percent of physicians going to jail were black.
The other fifteen percent were physicians who took care of black patients. From the early two thousand until now physicians have been arrested, convicted, and incarcerated for prescribing controlled medication.
Again black and brown physicians have disproportionately been the victims. During this same period, health disparities within the black community increased. While many reasons have been put forward as to the cause of these disparities certainly the prosecution of black and brown physicians becomes the leading one.
When addiction moved from heroin and crack cocaine to medically prescribed opiate pain medication and overdose deaths victims went from black and brown to white people, the opiate epidemic took center stage. Like most crises, the government and law enforcement reacted without fully understanding what they were dealing with.
Laws were passed and people including health care providers went to jail. Pharmaceutical companies were blamed for knowingly manufacturing a “Highly Addictive” medication and physicians were accused of ” Over-Prescribing”.
Even though the Controlled Substance Act was intended to regulate the manufacture, prescribing, and dispensing of the five classes of controlled medication, law enforcement used it to show a violation by charging health care providers with not prescribing the medication for a professional purpose or for a legitimate medical reason.
Without offering any proof of the violation they were able to convict health care providers and have them sentenced to 20 to 30 years in jail including some to life in prison.

How could this come about when congress passed a regulatory act, not a criminal act? Who is responsible for the arrest and incarceration of these health care providers who legally prescribed controlled medication to patients in good faith?
In June the Supreme Court will hand down a decision in the appeal by Dr. Raun et all that will determine the prescribing habits of physicians going forward and the doctor-physician relationship.
Let’s hope they finally exonerate these innocent health care providers who were only trying to help their patients. We need to investigate the origin of these attacks and find out who is in charge. Administrations come and go.
There are however career civil service employees who remain in their positions getting promoted until they retire. These are the people who give information and influence policy from administration to administration. A political appointee is not interested in setting policy.

They leave that to the career employees. After all, they will only be holding their position for a few years enjoying the perks of free government because they supported the winner of the presidential election.
So we need to find and identify these individuals. I am sure they are responsible for all the misinterpretations of the laws that have convicted health care providers. We need to see if there were any financial incentives similar to the whistle-blower type benefits. Who is in charge?
