The American Medical Association (AMA) recently issued a report through its newly formed Substance Use and Pain Care Task Force recommending significant policy changes it believes would more effectively address the nation’s opioid epidemic. Stopping short of outright criticizing the DEA, the report proposes policy recommendations that run diametrically opposite to the DEA’s approach to the epidemic.
The report is simply the latest in a long line of published studies casting doubt on long-held assumptions about the opioid epidemic. We know there is no correlation between opioid-related mortality and the number of opioid prescriptions. We know abruptly discontinuing opioids lead to adverse patient outcomes. And we know forcing physicians to reduce the number of opioid prescriptions leads to a rise in counterfeit prescription opioids.

Dr. Ronald Myers was a leading advocate for health care to the poor and disenfranchised. The founder and chairman of The American Pain Institue and the Myers Foundation For Indigent Health Care and Community Development.
A 1985 graduate of the University of Wisconsin Medical School and residency in Family Practice at L.S.U. Medical Center, Doc Myers was a leading national advocate for health care to the poor and disenfranchised. In 1990 he became the first ordained and commissioned medical missionary to serve in America’s poorest region, the Mississippi Delta, in the history of the African American church. Dr. Myers provided health care to the poorest Americans through clinics in Tchula, Belzoni, Yazoo City, Indianola, Greenville, and Tupelo, Mississippi. He went on missions outreach to Kenya and Israel.

Yet in the eyes of the United States, Drug Enforcement Agency and the Department (DEA), this brilliant medical clinician was another uppidity-arrogant N-word who needed to be taught a lesson, criminalized, and imprisoned. Further, DEA specifically preys upon the practitioners of colors, especially older practitioners of both races as they are deemed likely to be more property-rich. This allows DEA to seize larger more valuable assets from their victims and it is more further assumed these practitioners are less likely to fight back making them easier enforcement targets.
Most importantly, the areas in the United States which have sustained the highest deaths of African American deaths from COVID are ironically nearly the exact same areas of the country where physicians, pharmacists, dentists, and healthcare providers of color have been targetted by DEA-DOJ and have been removed.

Rev. Ronald V. Myers, Sr., MD was a family practitioner in Mississippi. He lost his license because of attacks on him by the state of Oklahoma. The charges were dropped, but his license was never restored to active status because of fines levied on him by the Board of Medicine for the unfounded investigation they led against him. In other words, “Pay us for attacking you without just cause.”
Vilashin Ganesh MD. faces Nearly five years in FEDERAL PRISON after A fraudulent prosecution
Until Dr. Vilasini Ganesh’s ordeal began in 2016, she was living the American dream. She had a thriving medical practice, patients who looked up to her, and a beautiful home that she shared with her family― until she was accused of committing healthcare fraud and the FBI raided her Campbell Medical Group practice in Saratoga, California.
Married to Gregory Blecher MD., an Orthopedic Surgeon and co-defendant Ganesh was sentenced to over five years in prison after a federal grand jury convicted her of five counts of health care fraud and five counts of making false statements. She lost her thriving medical practice, her medical license, her home, savings, and peace of mind.
Throughout the trial and in closing, Ganesh claims, the prosecutors presented an extensive array of fraudulent evidence to the jury that did not prove any false claims submitted by her, but rather the claims of a completely different provider. Also, she was forced to go to trial with an attorney who provided no defense whatsoever, in violation of her constitutional rights.
ALPHA PHI ALPHA FRATERNITY SPOKE OUT AGAINST THE INJUSTICE DONE TO GREGORY BELCHER MD
Amici curiae members of Alpha Phi Alpha Fraternity Inc. submit this brief in support of Dr. Gregory Belcher’s petition for en banc review. The members of this organization are acutely aware that there are two sides to every story but only one truth and one correct application of justice. Alpha Phi Alpha urges this Court to accept en banc review because a core mission of the fraternity is to fight against unfair treatment African-Americans so often receive in our legal system. This case is important not only because the outcome is unjust but because it will deprive the community’s access to a well-trained Black physician.
As an African American doctor, Dr. Belcher brings a unique skill set and set of life experiences that are desperately needed in the Black community by patients as well as his orthopedic surgery colleagues, including those who provided letters of support at Dr. Belcher’s sentencing in this matter.
At trial, evidence was introduced showing that Dr. Belcher never billed for services that were not received and that he provided free therapy for patients in need who did not have the medical insurance to cover it.
Following a trial in which he was indicted on fourteen federal charges, Dr. Belcher was convicted in 2018 of the single count of making a false statement in a healthcare matter, in violation of 18 U.S.C. § 1035. The jury acquitted Dr. Belcher of every other charge brought by the U.S. Attorney’s Office, which included healthcare fraud, conspiracy, and money laundering.
The single conviction stems from Dr. Belcher including the wrong date on the invoice for a $217 therapy session. Patient M. Habibi received the therapy on November 22, 2013, while the date on the billing record was November 23, 2013. He has been sentenced to 12 months one day prison to report on January 8, 2022, they have 3 small children together.
DOCTORS OF COURAGE
Healthcare advocate and founder of Doctors of Courage, Linda Cheek MD, believes the Department of Justice has cookie-cutter methods that they use now against doctors, more and more of which are actually criminal in action, breaking the law to convict an innocent doctor.
“Even when as in Dr. Ganesh’s case, egregious false evidence is used to convict her, and when exposed, the court does nothing to correct the law-breaking or hold those who did it responsibly. This gives the entire DOJ license to break the law to convict innocent people,” she told NRI Pulse via email.
“Techniques that the DOJ uses regularly, and are even being trained to use, are to modify records that are brought into trial. Changing names and dates on medical records, redacting exculpatory evidence on the chart, and altering audio recordings of visits are just some of the egregious actions. They also then force patients of the doctor to be witnesses and commit perjury or face charges of possession with intent to distribute and go to prison themselves if they don’t.”
“In all of the cases I have researched, I have yet to find a single one where these tactics have not been used to get a doctor to either plea or be convicted in court.”
Cheek said these same tactics were used against her, “including the government calling in a prescription illegally in my name to add to my charges. Every doctor that has contacted me about their case expresses their surprise at the illegal actions the DOJ has used against them. And yet none of this is exposed.”
Ganesh believes her case could set a very dangerous precedence for government abuse of power against physicians, business owners, government contract workers, tech executives, even Wall Street CEOs.
