THE DEA, A CRIMINAL ENTERPRISE ARMED WITH BADGES GUNS, AND PROFOUND STUPIDITY

Once again we write, in a time when rule of law descended into mob rule, literally and figuratively, certain individuals rose to prominence with alarming alacrity.

Politically ambitious, morally ambiguous, these individuals used the pretense of law to unleash lawlessness throughout the land, from the general public to the courts of law.

CRIMINALIZING MEDICAL PROTOCOLS BY DEA

Nowhere was this more manifest than in the investigation and adjudication of statutes around the opioid epidemic – in which extreme, medically inappropriate interpretations of the laws created a disparity between the law’s intention and its implementation.

Over the last several years there has been an increase in arrests, convictions, and incarceration of physicians who prescribe opiate pain medication. This increase is associated with the 2016 CDC guidelines and the misapplication of those guidelines by DOJ/DEA.

80-YEAR-OLD MD ARRESTED FOR TREATING PAIN

In guidelines 90, MME is mentioned as a goal. The DOJ/DEA has wrongly decided that these are not guidelines but laws or rules. At a recent trial, the government’s star witness Dr. Timothy King said that 90 MME’S was the “absolute” threshold when prescribing opiate pain medication. Nothing could be further from the truth.

I have enclosed an official statement from the CDC regarding the 2016 guidelines and their misapplication. The AMA has written several articles questioning the validity of this measurement.  The CDC should never have issued guidelines concerning medication in the first place.

The FDA is the government agency responsible for approving medication. Once a medication is approved the physician has the sole authority to prescribe any medication they feel is medically necessary. There is no authority that can say otherwise including the DOJ/DEA.

JAY K. JOSHI MD:

THE DAILY REMEDY________

“We request a civil rights investigation into violations of healthcare rights for those disenfranchised during the opioid epidemic – in which the fear of prosecution defines the quality of patient care.”

THE TRUE UNDERSTANDING OF OPIATE MEDICATIONS AND HOW THEY WORK

There is too much emphasis on people and not enough on opiate medication. When a person takes medications it breaks down to their active ingredient and is transported to where it acts. Opiates are no different.  It breaks down to its active ingredient and attaches to opiate receptors in the brain and other parts of the body. Three opiate receptors have been identified with the Mu receptor discovered in 1972. Since then Delta and Sigma receptors have been identified.

The Mu receptor is responsible for euphoria and plays a major role in addiction.  When the opiate loses its affinity for the receptor it reenters the circulation and is detoxified by the liver and eliminated from the body.

The rate of metabolism varies from individual to individual. It cannot be voluntarily controlled by anyone. Once activated it can’t be turned off. Addiction is a chronic disease and must be treated as such.

Addiction is not a crime. The other problem is what happens when a physician is arrested?  I call it unintended consequences. When a person is on opiate pain medication they generally take their last medication on the day of their appointment or several days before their appointment.

When they show up for their appointment the doctors’ office is closed.  Their doctor has been arrested. His medical license and DEA license have been seized. There is a sign on the door with a number to call. They quickly go into withdrawal, go to the streets, overdose, and die.

FOLLOW THE SCIENCE

This happened to 2 of my patients who were being treated for opiate addiction with Suboxone. Thousands of individuals have died as a result of physicians losing their medical and DEA licenses upon arrest and before conviction.

What profession or individual in the United States is guilty prior to a trial? I believe that there should be an immediate halt in all legal proceedings involving physician arrest and trial until these issues are resolved. Innocent people are dying.
